Breaking update on PEC’s VFOIA lawsuit against Orange County

Dear Supporter,

In a positive development related to The Piedmont Environmental Council’s Virginia Freedom of Information Act (VFOIA) lawsuit against Orange County, the County on Thursday provided copies of nondisclosure agreements (NDAs) that were previously withheld.

Ten local officials, including elected members of the Board of Supervisors, signed NDAs “for the benefit of Amazon.com, Inc. and its affiliates.” In addition, the County has agreed to re-review other requested documents referenced in our complaint and to provide us, by Dec. 8, a privilege log that lists those withheld documents.

As a result of these developments, the hearing scheduled for today, Friday, Nov. 17 in Orange County Circuit Court has been deferred.

Once Orange County provides the privilege log, PEC’s legal counsel will evaluate whether these materials have been properly withheld. If we determine documents were in fact improperly withheld in violation of VFOIA, we will request another hearing to pursue the production of those documents.
